Recently, I was speaking with a client, and we were discussing the different rights that a taxpayer has. One of those rights is a Collection Due Process hearing, also known as a CDP. There are various instances when this type of request may be available. One situation is when the IRS files a notice of federal tax lien. In such cases, you can request a Collection Due Process hearing. Another circumstance is when the IRS threatens to take some type of levy action, like a bank levy or seizure. If the IRS has issued a final notice of intent to levy, you also have the right to request this type of hearing. The benefit of having this hearing is that you get to go to the IRS Appeals Office. It is an independent office that is supposed to make an unbiased decision regarding the collection actions the IRS is considering or threatening to take. During this process, there is a hold on enforcement in those tax periods until the hearing is held and a determination is made.
